Welcome to B2C Databases!

These Terms and Conditions ("Terms") govern your access and use of the services, products, and data lists ("Datasets" or "Data") provided by B2C Databases, established in 2023 in Bacolod City, Philippines.

By purchasing, downloading, or using any Dataset from B2C Databases, you enter into a legally binding agreement to comply with these Terms. If you do not agree with any part of these Terms, you must not proceed with any purchase or use of our services.

As a client of B2C Databases, you agree to the following conditions:

3.1 Lawful Use is Mandatory: You warrant and agree that you will use all purchased Data in strict compliance with all applicable local, national, and international laws and regulations. This includes, but is not limited to, laws governing data privacy, unsolicited electronic communication (e.g., CAN-SPAM, GDPR, PH laws like the Data Privacy Act of 2012), telemarketing (e.g., Do Not Call registries), and consumer protection.

3.2 No Resale or Redistribution: The Data is licensed for your internal business use only (e.g., marketing, lead generation, analysis). You are strictly prohibited from reselling, redistributing, leasing, or otherwise sharing the Data, in whole or in part, with any third party, affiliate, or other business entity.

3.3 Data Integrity and Security: You are responsible for implementing appropriate technical and organizational measures to secure the Data and prevent unauthorized access, disclosure, alteration, or destruction.

3.4 Opt-Out Compliance: You must promptly honor all unsubscribe, opt-out, and "Do Not Contact" requests from individuals on the Data lists and maintain your own suppression list accordingly.

3.5 Prohibited Activities: You shall not use the Data for any illegal, harassing, defamatory, abusive, or discriminatory purpose.

 

4. Data Quality and Limitations of Liability

 

4.1 Data Accuracy: B2C Databases uses commercially reasonable efforts to compile the most accurate and up-to-date information. However, due to the inherent nature of contact data—which is constantly changing—we cannot and do not guarantee 100% accuracy, currency, or completeness of any Dataset.

4.2 "As-Is" Basis: All Datasets are provided on an "as-is" basis, without warranties of any kind, whether express or implied. B2C Databases disclaims all warranties, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

4.3 Exclusive Liability Limit: Your sole remedy for any issue with the Data shall be a refund or replacement of the specific inaccurate or incomplete portion of the Data, at the discretion of B2C Databases, and only if a verifiable error is reported within 7 days of purchase. In no event shall B2C Databases' liability exceed the amount you paid for the specific Dataset in question.

 

5. Payment, Delivery, and Refunds

 

5.1 Pricing and Payment: All prices are as quoted on our service agreements or invoices. Payment must be completed in full before the Data is delivered.

5.2 Delivery: Datasets are typically delivered electronically via secure download link or email.

5.3 No General Refunds: Due to the nature of digital data products, all sales are final and non-refundable, except in the limited case of verifiable data inaccuracy as outlined in Section 4.3. Once the Data has been downloaded or emailed to you, it cannot be returned.

 

6. Intellectual Property

 

B2C Databases retains all intellectual property rights, ownership, and title to the Datasets, including the compilation and selection methodology, even after the Data is sold to you. You are granted a non-exclusive, non-transferable, limited license for internal use only.

You agree to indemnify, defend, and hold harmless B2C Databases, its owners, and employees from and against any and all claims, damages, liabilities, costs, and expenses (including attorney's fees) arising from:
